Community Solar Privacy Policy

Syncarpha Solar, LLC (collectively, "Syncarpha," "we," "us," or "our") is committed to your privacy. This privacy policy ("Policy") describes how we collect, use, and share your information in connection with the Syncarpha website at syncarpha.com (the "Site") and the products and services offered by us, including our Community Solar offering (the "Services"). Please read this policy carefully to understand our practices regarding your information and how we will treat it. By visiting our Site and/or using the features made available to you on the Site, you are agreeing to the terms of this Policy.

What personal and other information we collect about you

Syncarpha may collect both personal information and other information about users who access our Site or Services. For purposes of this Policy, “personal information” is information such as a name or email address that we can directly associate with a specific person or entity without additional information. “Other information” is any additional information we collect that is not personal information. When we combine personal information with other information, we will treat all of the combined information as personal information and protect it in accordance with this Policy.

Personal Information. You can visit the Site without submitting any personal information. However, if you use certain features on the Site, such as the “Sign Up Now” form or otherwise register as a user for the Site, you will be required to provide personal information. This information may include your:

  • Name
  • Address
  • Telephone number
  • Email address
  • Referral information
  • Average monthly electric utility bill and energy usage

If you sign up for our Services or create an account on our Site, we may collect additional information about you. For example, we may ask whether you own your home. We also may ask you to submit copies of your utility billing statements or information necessary for us or our partners to run a credit check, such as your Social Security number. We also may collect payment information such as your credit card or other financial information. If you open an account on the Site we will record a username and password, and you will have the opportunity to provide additional information in connection with your account.

In addition, we may collect personal information about you from third-party sources. For example, with your consent, we may receive information about your credit history or credit scores from credit bureaus. We also may obtain additional information about your utility usage directly from your utility providers. And our third-party marketing providers may also share with us additional information that you provided to them, such as your energy usage patterns, planned energy improvements, or other factors that may change your energy usage in the future.

Finally, we also may collect information from our communications with you via email, postal mail, or telephone, on sign-up forms at community events, and from your customer service records with us. When we combine personal information collected through the Site with information that we or third parties collect about you in other contexts, we will protect it in accordance with this policy.

Other information collected automatically. When you use the Site, we automatically collect other information from your computer (or other device) and your browser. This may include such data as your IP address and domain name, your use of the Site during your current session and over time (including, for example, the pages you visit on the Site and the files that you download), the date and time of your visit, the URLs from the websites you visit before and after navigating to the Site, your computer’s operating system and browser type, your software and hardware attributes, your Internet service provider, and your general geographic location (e.g., your city, state, or metropolitan region). We collect such information using the following technologies:

  • Web log data. When you use the Site, we automatically receive and record certain information using web logs or similar applications that recognize your computer and gather information about its online activity.
  • Cookies. We also use cookies on the Site. Cookies are small files that are stored on your computer by your web browser. A cookie allows the Site to recognize whether you have visited before and may store user preferences and other information. If you are concerned about having cookies on your computer, you can set your browser to refuse all cookies or to indicate when a cookie is being set, allowing you to decide whether to accept it. You can also delete cookies from your computer. However, if you choose to block or delete cookies, certain features of the Site may not operate correctly.
  • Web beacons. The Site or the emails that you receive from us or our partners may use an application known as a “web beacon” (also known as a “clear gif” or “pixel tag”). A web beacon is an electronic file that usually consists of a single-pixel image. It can be embedded in a web page or in an email to transmit information, which could include personal information. For example, it allows an email sender to determine whether a user has opened a particular email.

We also may partner with certain third parties to collect, analyze, and use some of the personal and other information described in this section. For example, we may allow third parties to set cookies or use web beacons on the Site or in email communications from Syncarpha. This information may be used for a variety of purposes, including online behavioral or interest-based advertising, as discussed below (see the section entitled “How we share personal and other information with third parties”).

How we use the personal and other information that we collect

Syncarpha may use the personal and other information that we collect for a variety of purposes, as described below.

Personal information. We may use the personal information we collect about you:

  • to respond to your questions concerning the Site or Services offered by Community Solar or our partners;
  • to provide the Services to you, fulfill the terms of any agreement you have with us, respond to your requests concerning the Site or our Services, or otherwise complete a transaction that you initiate;
  • to undertake credit checks (with your consent) and evaluate your eligibility for our Services;
  • to send you information about our Services or other topics that are likely to be of interest to you, including newsletters, updates, or other communications;
  • to deliver confirmations, account information, notifications, and similar operational and administrative communications;
  • to improve your user experience and the quality of our products and services;
  • to provide social networking and other sharing features;
  • to comply with legal obligations and/or regulatory requirements; and
  • to compile and share aggregated information.

Referral Program We may allow you to use a referral service to inform your friends about our Site or Services. In that case, we will ask you to provide your friend’s name, telephone number, postal address, and/or email address. We may send an email invitation inviting your friend to visit our Site and learn more about our Services and may follow up with direct mail, a telephone call, or in-person visit to their home. The information that you provide may be used to send emails to and personally contact such referred customers, track the success of our referral program, and provide benefits to participants. By using the referral feature, you represent that you are entitled to use and provide us with the recipient’s name, telephone number, postal address, and email address for these purposes.

Other information. We may use other information to manage our business and to improve your user experience and the quality of our Site and Services. For example, we use other information for such purposes as: counting and recognizing visitors to the Site; analyzing how visitors use the Site and various Site features; improving the Site and enhancing users’ experiences with the Site; creating new products and services or improving our existing products and services; enabling additional website analytics and research concerning the Site; and managing our business. Syncarpha may link information gathered using cookies and web beacons with personal information. But in that event, we will treat the combined information as personal information.

How we share personal and other information with third parties

Syncarpha shares your personal information and other information with third parties for a variety of purposes, as described below.

Analytics and online behavioral (interest-based) advertising. We partner with certain third parties to collect the other information discussed above and to engage in analysis, auditing, research, and reporting. These third parties may use web logs or web beacons, and they may set and access cookies on your computer or other device.

In particular, the Site may use Google Analytics to help collect and analyze certain information for the purposes discussed above. You may opt out of the use of cookies by Google Analytics here. In addition, the Site may use Adobe Analytics to help collect and analyze certain information for the purposes discussed above. You may opt out of the use of cookies by Adobe Analytics here.

The Site also enables third-party tracking mechanisms to collect other information about you for use in online behavioral advertising. For example, third parties may use the fact that you visited the Site to target online ads for Syncarpha services to you on non-Syncarpha websites. In addition, our third-party advertising networks might use information about your use of the Site to help target non-Syncarpha advertisements based on your online behavior in general. For information about behavioral advertising practices, including privacy and confidentiality, visit the Network Advertising Initiative website or the Digital Advertising Alliance website.

The use of online tracking mechanisms by third parties is subject to those third parties’ own privacy policies, and not this Policy. If you prefer to prevent third parties from setting and accessing cookies on your computer, you may set your browser to block cookies. Additionally, you may remove yourself from the targeted advertising of companies within the Network Advertising Initiative by opting out here, or of companies participating in the Digital Advertising Alliance program by opting out here.

Most browsers offer “do not track” features that let you communicate to websites that you do not wish to be tracked around the web. At this time, our Site does not respond to “do not track” browser headers, but you may limit tracking through these third-party programs by taking the steps discussed above.

Third-party service providers and business partners. Syncarpha also uses other third-party service providers to help us manage and improve the Site and our Services. These service providers may collect and/or use your personal or other information to assist us in achieving the purposes discussed above in the section entitled “How we use the personal and other information that we collect.” For example, we use third parties to help us perform credit checks, evaluate customers’ energy usage patterns, forecast future energy usage and pricing, process transactions, manage our information systems, target and deliver marketing and administrative communications, and manage our relationships with the people and companies that use our Site and Services.

We also may share your personal or other information with other third parties in order to fulfill your requests for services; to complete a transaction that you initiate; to meet the terms of any agreement that you have with us or our partners; or to manage our business.

Your direct sharing of personal information through third-party websites and services. The Site may enable you to share directly personal information with websites or online services operated by third parties. For example, the Site may contain links to third-party websites that incorporate comment and social media features. If you choose to use these features, you may disclose your personal information not just to those third-party websites and services, but also to their users and the public more generally. Because these third-party websites and services are not operated by Syncarpha, we are not responsible for the content or practices of those websites or services. The collection, use, and disclosure of your personal and other information will be subject to the privacy policies of the third party websites or services, and not this Policy.

Third-party plugins. The Site may integrate certain third-party plug-ins (such as a social media “like,” “share,” or “follow” button). Even if you do not click on these plug-ins, they may collect information about you, such as your IP address and the pages that you view. They also may set and/or access a cookie. These plugins are governed by the privacy policy of the company providing them.

Legal purposes. Syncarpha also may use or share your personal or other information with third parties when we believe, in our sole discretion, that doing so is necessary:

  • to comply with applicable law or a court order, subpoena, or other legal process;
  • to investigate, prevent, or take action regarding illegal activities, suspected fraud, violations of our terms and conditions, or situations involving threats to our property or the property or physical safety of any person or third party;
  • to establish, protect, or exercise our legal rights or defend against legal claims; or
  • to facilitate the financing, securitization, insuring, sale, assignment, bankruptcy, or other disposal of all or part of our business or assets.

Aggregated information. Syncarpha also may compile and share de-identified and aggregated information about Site users, such as by publishing a report on trends in the usage of the Site or Services.

Security and retention

Syncarpha uses commercially reasonable physical, electronic, and procedural safeguards to protect your personal information against loss or unauthorized access, use, modification, or deletion. However, no security program is foolproof, and thus we cannot guarantee the absolute security of your personal or other information. We will retain your Personal Information for as long as reasonably necessary to accomplish the purposes in this Policy or as required by law.

Reviewing, updating, and deleting your information

You may have additional rights under applicable law to access, amend, and/or request deletion of certain information that Syncarpha has about you. To inquire about such rights or to learn more about the personal information that we have about you, please contact us by email at privacy@syncarpha.com. For your protection, we may elect to implement requests only with respect to the information associated with the particular email address you use to send us your request, and we may need to verify your identity before implementing your request.

Your choices for marketing communications

We may use the personal and other information that we collect to send you promotional communications, including emails or postal mail about the products and services offered by Syncarpha or our partners. Although we hope that you will find our marketing communications of interest, you may opt out of receiving them by following the instructions provided in our promotional emails. Your California Privacy Rights. California law gives residents of California the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal information with third parties for their direct marketing purposes. Because our Policy gives you a choice of opting out of having your personal information disclosed to third parties for their direct marketing purposes, we may instead provide you with information on how to exercise your opt-out preferences. Please see above if you wish to learn more about restricting the sharing of your personal information with third parties for their direct marketing purposes.

Transfer of information to the United States

The personal and other information that Syncarpha collects through or in connection with the Site and Services is transferred to and processed in the United States for the purposes described above. We may subcontract the processing of your data to, or otherwise share your data with, affiliates or third parties in the United States or countries other than your country of residence. The data protection laws in these countries may be different from, and less stringent than, those in your country of residence. By accepting this Policy, accessing this Site, or providing information to us, you expressly consent to such transfer and processing.

Children’s privacy

The Site is not directed to children under the age of 13, and Syncarpha does not knowingly collect personal or other information from anyone who is under the age of 13.

Changes to this Policy

Syncarpha may amend this Policy from time to time to reflect the changes in our business and practices, and so you should review this page periodically. Unless otherwise stated, the revised version will be effective at the time we post it. If we make a material change we will notify you of the changes by posting a Policy Update and update the ‘last modified’ date at the bottom of this page.
